The Court Rejected Abba Kyari's Request
The Federal High Court in Abuja has dismissed the request brought before it by the former head of the intelligence gathering department of the Nigerian Police Force, Abba Kyari, asking the court to dismiss the allegations against him.
During the court session on Wednesday, Justice Emeka Nwite rejected the request of Abba Kyari, saying that the court has jurisdiction to hear cases related to drug dealing as per the constitution and the law. She established the NDLEA and they gave her a chance.
Abba Kyari told the court that the NDLEA has rushed to bring him before the court, even before the investigation was completed, saying that the agency should have given the police the opportunity to conduct an internal investigation before the NDLEA took step.
He added that the police investigated the matter and submitted an internal report to the police force.
The police officer said that he will be brought before the court only when the police have completed the investigation.
He also said that the Police Act states that the National Police Service Commission has the power to investigate and discipline police officers, just as the Supreme Judicial Council has the power to discipline judicial officers.
However, the judge of the court said that the authority of the police commission did not exceed the authority of the federal court.
Kyari, who is the deputy commissioner of police, along with four other people who work in the same unit are facing charges of conspiracy to smuggle 17.55 kilograms of narcotic drugs.
