Binani filed an appeal to the court on the need to declare her as the winner of the election
Senator Aisha Binani Dahiru, an APC candidate for governor of Adamawa State, filed a lawsuit at the Federal Court in Abuja, asking the court to reconsider the Independent Electoral Commission's (INEC) pronouncement that she had won the governorship election that ended on April 16.
In addition, Binani requested that the court halt INEC and its officials from announcing the election's winner until the court has finished reviewing the petition that was submitted to it.
Aisha Binani Dahiru said that this holds true for Section 251 1 in parenthesis q and r of the Constitution of 1999, Section 149, and Section 152 of the Revised Electoral Law of 2022, as well as for Law 34-1 A, Law 31 in parenthesis, Law 3-2 in parenthesis, and Law 6 of the Federal High Court of 2019.
According to the evidence of the case Aisha Binani Dahiru presented to the court after INEC had tallied the election results, she had filed a lawsuit against the organization as the first plaintiff and had declared herself the winner of the contest, but the PDP and Ahmadu Fintiri's governorship campaign, whom she had named as the second and third plaintiffs, had started to incite unrest in the state, where all of the INEC employees had been mistreated.
She said that the crises' instigation led INEC, which does not have the authority to do so because the election hearing court alone has this authority, to postpone the announcement of the results.
She claimed that by retracting her announcement as the election's victor, INEC had acknowledged the court's authority to consider election appeals.
She argued for the court to reconsider my designation as the election's victor through her attorneys, who were led by senior attorney Hussaini Zakariyau.
The senator claimed in the petition that only the court, not INEC itself, has the authority to take legal action against an INEC official.
