The Court Refused to Extend the Prosecution Order for Four More

The Independent National Electoral Commission (INEC), the Inspector General of Police (IGP), and the Attorney General of the Federation (AGF) were suspended from prosecuting the suspended Adamawa State Electoral Commissioner, Hudu Yunusa Ari, on Tuesday. The Federal High Court in Abuja declined to extend the interim period it had granted on July 10, 2023.

Hudu Yunusa Ari is being investigated by INEC for announcing Senator Binani, the APC party's nominee for governor of Adamawa state on April 15, 2023, as the winner while the votes were still being counted.

The defendants in this action, INEC, IGP, and AGF, were instructed by the court to remain in their current positions until an appropriate resolution was made.

The court also ordered the defendants to come before it on July 18 and provide justification for why they should not be permanently disqualified from bringing charges against the state of Adamawa's suspended Electoral Commissioner.

INEC's attorney, Rotimi Jacobs (SAN), informed the court during the hearing on Tuesday that the defendant failed to serve the court order on July 10.

But according to Binani's attorney, Michael Aondoaka (SAN), the defendants failed to provide justification as required by the court, therefore the interim order was still in effect.

The prosecution of Hudu Yunusa Ari was temporarily suspended, but the court declined to extend the suspension.
